    Agreement to Terms

    By accessing or using RECRUITED ("Service", "Platform", "we", "our", or "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Service.

    Description of Service

    RECRUITED is an email management platform designed to help high school athletes organize and track their college recruiting communications. Our Service includes:

    • Gmail integration for email synchronization
    • Email tracking and analytics
    • Coach and school database management
    • Email templates and blast tools
    • Dashboard and reporting features

    User Eligibility

    You must be at least 13 years old to use this Service. If you are under 18, you represent that you have your parent or guardian's permission to use this Service. By using the Service, you represent and warrant that you meet these eligibility requirements.

    User Accounts

    Account Creation

    To use our Service, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials.

    Gmail Connection

    By connecting your Gmail account, you authorize us to access your email data as described in our Privacy Policy. You can revoke this access at any time through your Google Account settings.

    Account Security

    You are responsible for all activities that occur under your account. Notify us immediately of any unauthorized access or security breach.

    Subscription and Billing

    Auto-Renewal

    All paid subscriptions automatically renew at the end of each billing period unless cancelled in advance:

    • Monthly subscriptions automatically renew each month on the same day you subscribed
    • Annual subscriptions automatically renew each year on the anniversary of your subscription start date
    • You will be charged using the payment method on file at the then-current subscription rate
    • We will send you a reminder email before your subscription renews

    Cancellation Policy

    You may cancel your subscription at any time through the Settings page:

    • Cancelled subscriptions remain active until the end of the current paid period
    • After the paid period ends, your account will revert to free tier limitations
    • No prorated refunds are provided for partial billing periods
    • You may re-subscribe at any time to regain full access

    Account Deletion

    You may permanently delete your account at any time through the Settings page:

    • Account deletion immediately and permanently removes all your data, including profile information, emails, templates, blasts, and contact history
    • Deleted data cannot be recovered under any circumstances
    • If you have an active paid subscription at the time of deletion, it will be cancelled immediately with no refund for the remaining period
    • Account deletion is final and irreversible

    Acceptable Use

    You agree NOT to:

    • Send spam or unsolicited bulk emails
    • Violate NCAA rules or recruiting regulations
    • Misrepresent your identity or qualifications
    • Use automated systems to access the Service without authorization
    • Attempt to gain unauthorized access to our systems
    • Upload malicious code or viruses
    • Harass, abuse, or harm others
    • Violate any applicable laws or regulations
    • Share your account with others
    • Export, scrape, crawl, or bulk-extract any data from the platform
    • Use data for purposes other than your personal recruiting outreach
    • Share, resell, or redistribute any data obtained from the Service
    • Share access credentials or data with unauthorized parties

    Email Tracking

    Our Service includes email tracking features that notify you when recipients open your emails. You are responsible for complying with all applicable laws regarding email tracking and consent. By using these features, you represent that you have the right to track the emails you send.

    Content Ownership and Responsibility

    Your Content

    You retain ownership of all content you create or upload, including emails, profile information, and templates. You are solely responsible for the accuracy and legality of your content.

    License Grant

    By using our Service, you grant us a limited license to store, process, and display your content solely for the purpose of providing the Service to you.

    Intellectual Property

    The Service and its original content, features, and functionality are owned by RECRUITED and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express permission.

    Third-Party Services

    Our Service integrates with Google Gmail. Your use of Gmail is subject to Google's Terms of Service and Privacy Policy. We are not responsible for third-party services or their policies.

    Coach and Contact Information

    Our Service includes a database of college coaches and program contacts to help you with recruiting outreach. While we make best efforts to maintain accurate and up-to-date contact information:

    • Contact information (including email addresses and roles) may change over time
    • We do not guarantee the accuracy or completeness of any coach or program contact data
    • You should verify contact information on official athletics or program websites when needed
    • You can report inaccurate contact information through the "Report issue" feature

    By using our coach and contact database, you acknowledge that some information may be outdated and agree to use the data responsibly.

    Data Use and Restrictions

    Licensed Use Only

    The data contained within RECRUITED, including but not limited to coach contact information, program details, school data, and any other information in our database, is licensed exclusively for use by our paying customers for the purpose of personal recruiting outreach. This data may NOT be:

    • Exported, downloaded in bulk, or extracted from the platform
    • Resold, redistributed, licensed, or shared with third parties
    • Scraped, crawled, harvested, or collected using automated tools or scripts
    • Used for any commercial purpose beyond personal recruiting communications
    • Republished, displayed, or made available outside of the RECRUITED platform
    • Used to build or supplement competing databases or services

    Data Quality - Best Efforts

    RECRUITED provides data on a "best efforts" basis. While we strive for accuracy:

    • We continuously research and validate our data through publicly available sources
    • We rely on customer activity and feedback to help us keep data current and accurate
    • You can report inaccurate information through our "Report issue" feature
    • No guarantee is made regarding the completeness, accuracy, or timeliness of any data
    • Data may become outdated between validation cycles

    Violation Consequences

    Violation of these data use restrictions may result in immediate account termination without refund and potential legal action to recover damages and enforce our intellectual property rights. We reserve the right to pursue all available legal remedies against individuals or entities that scrape, export, or misuse our data.

    Disclaimer of Warranties

    THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. We do not guarantee that the Service will be uninterrupted, secure, or error-free. THIS INCLUDES, WITHOUT LIMITATION, ANY WARRANTY REGARDING THE ACCURACY OF COACH OR CONTACT INFORMATION IN OUR DATABASE.

    Limitation of Liability

    TO THE MAXIMUM EXTENT PERMITTED BY LAW, RECRUITED SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICE.

    NCAA Compliance

    While our Service helps you manage recruiting communications, you are solely responsible for ensuring your communications comply with NCAA rules, conference regulations, and your school's policies. We do not provide legal advice regarding recruiting regulations.

    Termination

    We reserve the right to suspend or terminate your account at any time for:

    • Violation of these Terms
    • Fraudulent or illegal activity
    • Request from law enforcement
    • Extended inactivity

    You may terminate your account at any time through the Settings page. Upon termination, your right to use the Service will immediately cease.

    Changes to Terms

    We reserve the right to modify these Terms at any time. We will notify you of significant changes via email or through the Service. Your continued use of the Service after changes constitutes acceptance of the modified Terms.

    Governing Law

    These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
